TERMS OF SUBMISSION

By submitting your photograph (the “Photo”) to Genital Electric (“GenElec” or “us” or “our” or “we”), you represent and warrant that: (a) you are at least 18 years of age; (b) the Photo is your original work; (c) the Photo does not violate the rights of any third party; (d) the Photo does not contain any content that reflects any subject other than yourself; and (d) the Photo does not violate any applicable legislation or regulation. 

At all times, you own the copyright in the Photo. However, by submitting the Photo to GenElec, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to create an original work of art from it (a derivate work, the “Artwork”) and to use the Artwork as described herein as well as to host, store, transfer, display, reproduce, sell, and distribute the Artwork. You give us permission to publish the Artwork in any and all media, either print or digital, including but not limited to on the genitalelectric.art website, as well as all GenElec social media accounts including, but not limited to, Instagram. We may use the Artwork for our own promotional and marketing purposes, or as part of third-party promotional use, and you hereby certify that GenElec is not required to make any payment to you or any third party for any such promotional use. In the event that GenElec sells the Artwork in its online store or on a third-party e-commerce platform, you agree that you are not entitled to receive any proceeds of any sale. You understand that, once submitted, we are not required to return the original Photo file to you.

Whether or not to take on a commission to create an Artwork from the Photo is in GenElec’s sole discretion. Any deposit paid to GenElec is non-refundable. The Artwork, once created, may be used by you for personal use only. The Artwork may not be sold, transferred, licensed, or donated by you without GenElec’s express written approval, and you agree that you will so notify any third party to whom you wish to make the sale, transfer, license, or donation of this restriction.

The copyright in the Artwork is owned exclusively by Genital Electric.
